Đây là lần đầu tiên vi phạm trần lãi suất bị xử lý kể từ khi cơ chế trần được áp dụng vào tháng 3/2011.
Ngày 14/9, Giám đốc Ngân hàng Nhà nước chi nhánh tỉnh Tây Ninh đã có Quyết định số 119/QĐ-TNI về việc xử lý vi phạm huy động vốn vượt trần lãi suất 14%/năm tại Ngân hàng Thương mại Cổ phần Đông Á (DongA Bank) chi nhánh Tây Ninh.
Theo đó, quyết định miễn nhiệm chức danh Giám đốc đối với ông Nguyễn Thái Hậu, Giám đốc DongA Bank Tây Ninh.
Ngày 15/9, Chánh Thanh tra, giám sát ngân hàng cũng đã có văn bản số 7235/NHNN-TTGSNH yêu cầu DongA Bank kiểm điểm nghiêm túc trong việc chỉ đạo điều hành trong toàn hệ thống về việc chưa chấp hành nghiêm quy định về mức lãi suất huy động vốn bằng đồng Việt Nam theo Thông tư 02/2011/TT-NHNN và Chỉ thị số 02/CT- NHNN, để xảy ra trường hợp huy động tiền gửi tiết kiệm VND vượt trần lãi suất 14%/năm tại chi nhánh trên.
Chánh Thanh tra yêu cầu ngân hàng này có quyết định xử lý kỷ luật nghiêm khắc đối với tập thể và cá nhân liên quan tại chi nhánh Tây Ninh vì đã có hành vi vi phạm Chỉ thị 02/CT-NHNN ngày 7/9/2011 của Thống đốc Ngân hàng Nhà nước về việc chấn chỉnh việc thực hiện quy định về mức lãi suất huy động bằng đồng Việt Nam và đồng đô la Mỹ của các tổ chức tín dụng, chi nhánh ngân hàng nước ngoài.
Cụ thể, DongA Bank không bố trí chức vụ quản lý, điều hành đối với ông Nguyễn Thái Hậu, nguyên Giám đốc DongA Bank chi nhánh Tây Ninh tại chính DongA Bank trong thời hạn 3 năm; xử lý đối với bà Lâm Thị Minh Ánh, nguyên Trưởng phòng kế toán DongA Bank chi nhánh Tây Ninh bằng hình thức buộc thôi việc.
Trong thời hạn 1 năm kể từ ngày 14/9/2011, DongA Bank không được mở chi nhánh, phòng giao dịch, đặt máy ATM trong phạm vi toàn quốc.
Ngoài ra ngân hàng này phải có văn bản cam kết thực hiện nghiêm túc Thông tư số 02/2011/TT-NHNN ngày 3/3/2011 và Chỉ thị số 02/CT-NHNN ngày 7/9/2011 của Thống đốc Ngân hàng Nhà nước; tăng cường công tác kiểm tra nội bộ đối với hoạt động kinh doanh nói chung và hoạt động huy động vốn nói riêng, đảm bảo chấp hành nghiêm túc các quy định của Thống đốc Ngân hàng Nhà nước và các đồng thuận đã cam kết với Hiệp hội Ngân hàng.
Thời hạn DongA Bank hoàn thành thực hiện các kiến nghị, chấn chỉnh sau kiểm tra, báo cáo Thống đốc Ngân hàng Nhà nước (qua Cơ quan Thanh tra, giám sát ngân hàng) trước ngày 30/9/2011.
Liên quan đến hiện tượng vượt trần lãi suất huy động, Ngân hàng Nông nghiệp và Phát triển Nông thôn (Agribank) báo cáo, tại Agribank chi nhánh Ba Đình, tỉnh Thanh Hóa, ngày 9/9/2011, bà Nguyễn Thị Thủy gửi tiền tiết kiệm có kỳ hạn 1 tháng, số tiền 1 tỷ đồng với lãi suất 14%/năm, chi nhánh này không chi thêm cho khách hàng này bất kỳ khoản chi nào, nhưng bà Bùi Thị Sáu là cán bộ tín dụng đã tự ý dùng tiền cá nhân tặng quà cho khách hàng với số tiền mặt 1 triệu VND, vi phạm quy định của Ngân hàng Nhà nước và của Agribank.
Agribank đã chủ động quyết định kỷ luật cán bộ có liên quan, cảnh cáo, chuyển công tác khác, hưởng bậc lương thấp hơn đối với bà Bùi Thị Sáu; cảnh cáo, chuyển công tác khác, hưởng bậc lương thấp hơn đối với bà Nguyễn Thị Huyền, cán bộ kế toán Agribank Ba Đình; khiển trách đối với ông Giám đốc Agribank Ba Đình và Giám đốc Agribank chi nhánh tỉnh Thanh Hóa.
Còn tại Phòng giao dịch Tôn Đức Thắng chi nhánh Agribank Sài Gòn, ngày 9/9/2011 đã xảy ra trường hợp cam kết chi thêm ngoài mức lãi suất tiền gửi bằng VND theo quy định của Ngân hàng Nhà nước. Agribank đã quyết định kỷ luật các cán bộ, nhân viên có liên quan: cách chức Phó giám đốc Phòng giao dịch đối với bà Nguyễn Thị Ngọc Lan; cảnh cáo Giám đốc Phòng giao dịch Tôn Đức Thắng; khiển trách đối với ông Võ Việt Hùng, Giám đốc Agribank chi nhánh Sài Gòn.
Như vậy, đến thời điểm này, hai trong số 7 tổ chức tín dụng có “dấu hiệu” vi phạm quy định trần lãi suất được công bố trước đó đã chính thức có kết luận là vi phạm và bị xử lý. Trước đó, một số trường hợp khác như Ngân hàng Hàng Hải (Maritime Bank), Ngân hàng Sài Gòn - Hà Nội (SHB) cũng đã được kết luận là không vi phạm quy định.
